First Reading of "Just Cause" eviction ordinance by Board of Supervisors

  • Marin County Civic Center, Room 330 (map)

The Marin County Board of Supervisors will conduct a First Reading on Tuesday, December 4, 2018 at 5:30 PM of an ordinance to establish a “Just Cause” for eviction policy for rental properties in unincorporated areas of Marin.

A typical “Just Cause” eviction ordinance limits the reasons a landlord may end a rental agreement beyond those identified by state law. Such an ordinance may also specify a notice-requirement to a tenant and other measures.

For example, members of the Board requested at their Sept 11th meeting that they be shown options for a data collection component, for relocation assistance to displaced tenants, and for a right of first return for tenants displaced by significant remodeling.

At this First Reading meeting, the Supervisors will review and discuss the draft ordinance for “Just Cause” eviction. County staff and others may present and explain the ordinance. Members of the public will be given an opportunity to speak briefly, typically for 2 minutes. Each Supervisor will then summarize their thoughts and recommendations to Staff. The Board may vote to proceed with the ordinance, which could lead to a Merit Hearing two weeks later, on Dec 18th. The Board may vote at the Merit Hearing meeting for passage of the ordinance.
